I think the real tragedy here is that cops can’t just say they smell marijuana and use that to gain access/excuse/exigency or what have you to bypass procedure or lead to possible busts for something else. Tragic for the police I mean. And that’s ok, I get it. I can sympathize with the cops, really. I mean, I’m always saying how I smell a rat, when in reality I don’t smell a rat. I’ve smelled a rat’s nest in the barn a few times and I know what they smell like. I just say I smell a rat when I know something nefarious is going on.
Do cops really think they might get shot every time they make a stop? I mean, is that a thing? Anyone know the ratio of traffic stops to police shootings?
    Histrionics….
I guess they don’t get anywhere being honest about the why for anything?
Kinda reminds me of the vehicle window tint laws.

The fact that marijuana was ever illegal in the first place is absurd. The fact that marijuana is used as a way to make warrantless contacts, searches and seizures is evil. This can also apply to any other substance, in my personal opinion. If the state really cared about addicts or the prevention of addicts, they would not profit off their misery, they would not be complicit in the trafficking of addictive substances, and they would not use prison as rehabilitation.
I do not have the answer to the legality of drugs or how to prevent drug addiction, but what I do have is enough sense to know that the system that we have is used against the people, not for the people.
So, this is a win. This will put a small dent in the war on drugs and any progress in that direction will always be positive.

We teach LA CHP classes and that question of "your vehicle as an extension of your home" is asked often.

We asked several attorneys to cite a Louisiana Revised Statue (LRS) that defines that phrase so we could share it with our students and no one could do so.

We think that some casualty insurance policies treat automobiles as extensions of the of the home for coverage purposes but that is not enshrined in the law.

Does anyone have a LRS cite that would clarify that exact statement?

In the years I've been on gun forums no one has ever posted a RS saying it.

The closest you will come is LRS 14:95.2(c)(5)

"Any constitutionally protected activity which cannot be regulated by the state, such as a firearm contained entirely within a motor vehicle."

I would think they are referencing the first part to be the Second Amendment and then the interpretation of the second line being the car as an extension of your home and saying a firearm is legal contained in the home.

Best I can do on this one.

One day you have to make a post on what happened to you in your past by a cop that gave you this trauma and mental illness towards Law Enforcement. Guarantee we all would love to read and learn. Its really clinical at this point. Your unhinged posts are screaming therapy needed.

It's called driving under the influence. You can drink booze at home, but not in your vehicle.

    Just my honest curmudgeonly response.
And you can have a open container in your home but not in your vehicle

    Really?

The back of my truck is outfitted as a camper. Bed, Stove, even a portlet.

I've got the better part of a bottle of Four Roses back there too.

What about people who live in motorhomes ? Must they abstain from drinking liquor, or are they forced to consume the entire bottle once it's opened ?

Blanket statements never end well, . . .

Here’s the new law as it applies to smoking marijuana in your vehicle.
    Thanks for posting that.
Not much of a deterrent in my opinion.

Whoever violates the provisions of this Section shall be fined one hundred dollars.
A law enforcement officer shall enforce the provisions of this Section only as a secondary action when the law enforcement officer detains a driver for another violation.
A violation of this Section shall be considered a nonmoving violation and a citation issued by a law enforcement officer for such violation shall not be included on the driver's operating record.

Is there any possible way you could maybe just jump up your own ass? That would truly serve a purpose here. So if you don’t mind getting that done, I’m sure there are a few folks here that would appreciate that.
There is nothing wrong with justice Mr Advanced Loser. There is nothing wrong with standing up for it in any capacity. I’ve never been abused by any law enforcement. I’m afraid your theory holds no water. I also don’t owe you an explanation for my beliefs. Go have a nice bowl of rock salad.
