Can I " recieve " this gun ?

A friend has a relative out of state that wants to send him a rifle . The rifle is C&R qualified . I have a Type 03 C&R . Can he send the rifle to me , and I in turn , give him the rifle ? It's not a sale , and the friend is not prohibited from owning the weapon .

I've seen an ATF response letter to this question before, they said that's a no-no.

Well with your C&R its okay if you give one away as a gift. You just better keep good records of it and not make it a habbit. Then they will think you are selling them.

Now....receiving a gun with the intention of giving it away is prob. on their no no list.
