Disturbing the peace

In the Marchiafava case, the exact charge was LRS 14:95, illegal carrying of a weapon. If you read it, I was not in violation of any subsection thereof. Hence, the DA, Tony Falterman, had enough sense to realize it. There were NO other charges.

DTP is no way the correct charge, there is no correct charge for OCing. OCing is not against the law.

George, you are exactly right, but an inordinate number of people seem to claim that they can/will do so anyway.

I was hoping to dispel this myth.

I'm trying to convince/motivate Ashton O'Dwyer to move on this matter. It's been waaaaaaaaaaaaaaaaaaaaaay too long, IMHO. As the old saying goes, "justice delayed is justice denied." I'm going to call him (again) right now. Thanks for asking.

Contact Denham Springs Police Department. They are of the opinion that if you open carry you are disturbing the peace and WILL be arrested. I was told that by some OIC (can't remember his name, but if you search BSC you'll find it).

You guys are forgetting one thing, DS may have a Local ordinanace for DTP that fits with OC and is not written the same way as the state. It may not say OC is DTP but may have some provision in there about creating a panic or something. I would suggest checking out the Livingston Parish ORdinances and City of DS ordinanaces before assuming that they dont apply. Remember a trip to the Town Hall/Courthouse records section costs less than Bail, Legal Fees, etc.
