Felony , or not ?

Saw a discussion this morning about people passing a stopped school bus . Someone said it was a Felony . So , assuming there is no vehicle accident or injury , etc. , is this a felony charge ?

Also, most people don't know the that you CAN pass a stopped school bus from the opposite direction if there is a hard neutral ground or a 4 lane road with a suicide turn lane in the middle.
