    How is it a jury can convict on the lesser offense of manslaughter when the defendant is charged with second degree murder, and the conditions for manslaughter are not evidenced by the facts of the case?

    Manslaughter is a homicide committed in the heat of blood, and if the blood cools, it's no longer manslaughter.

    When the defendant knelt in ambush for the cop chasing him, his blood was cool, as the cop nor anyone else had given cause that would rise defendant's blood. Indeed, a defendant surprised while in the commission of a felony crime has no claim of heat of blood if the police are merely attempting to apprehend the suspect in a legal manner.

    According to court testimony, the defendant in this case lay in wait for the cop and brought him down with a shot from a 38 Special through one thigh into the other. The defendant then proceeded toward the downed officer and executed him at close range with two torso shots from the same weapon. This hardly meets the heat of blood standard required for manslaughter under the Louisiana Criminal Code.

    I would think the judge would not allow a conviction on the lesser charge, and would declare a mistrial if the jury locked on the original charge.

    Methinks this is a good time for a lawful and peaceful protest march against this outrageous verdict, which defies common logic and the law. A good cop is dead and his scumbag drug swilling POS killer is basically walking after serving up to forty years.

    I don't expect Jesse Jackson or Al Sharpton to be in on this one. Those two don't get involved when justice works against the cops, but favors the downtrodden and persecuted minorities instead. Besides, they're all choked up and in tears about the inauguration anyway right now.

    On the other hand, a peaceful march could quickly turn violent under the circumstances. Maybe some busted store windows first, then a burning car or two and some gunshots in anger at hecklers, and before you know it, some good people have put the town of Lake Charles in turmoil. It a racial powder keg set to go off anytime to begin with. Forget about it. A march is off. Just read on and get your own rant up.

    I agree. How do you shoot someone 4 times at close range after attempting a felony burglary and call it manslaughter. It was obviously capital murder. Something was wrong with this jury.

    The racial makeup of the jury has never been publicized to my knowledge.

    Whatever it was, the verdict strongly suggests some degree of jury nullification.

    Not to worry. During his inaugural address moments as, President Barrack Obama strongly suggested we will pull together as one nation and do mo' better from this day forward.

    I wonder if that includes this fifteen-year-old-punk-ass-smuck and the thousands like him the FBI warned of in 1978:
