    HB519 Involuntarily deferred. Once again even the republicans are against it because SBR are "tactical"., and MAY be used against police. How's that for reasoning?

    I dont actually understand that SBR part. Say it was made "legal" in LA. You still have to comply with ATF and pay the tax stamp. There are no laws in LA prohibiting NFA items. We also no longer need CLEO sign off for state/city/parish.

    But you do still need that for the Feds if you go the individual route. I'm not saying the law makes since with the federal law already in place, I do like the idea of the states standing up for their rights over the federal government, but just pointing out that that is still required if going the individual route. Also 41p has been postponed and not necessarily thrown out so the possibility still exists of that expanding to trusts as well as individuals.

    According to the notes of the Bill:
    Authorizes the possession of of short barrel firearms without federal registration for lifetime concealed carry permit holders.
    Present federal law requires that a person register certain firearms in accordance with Title 18 or Title 26 of the United States Code as applicable.
    Proposed law provides that the holder of a lifetime concealed handgun permit may possess certain firearms without complying with the provisions of Title 18 or Title 26 of the United States Code
    Proposed Law defines a "firearm" as including a shotgun having a barrel of less than eighteen inches in length, a rifle having a barrel length of less than sixteen inches in length, or any weapon made from a rifle or shotgun if the weapon has been modified to have an overall length of less than twenty six inches.

    So the way I read it is if you are a lifetime concealed carry holder you do not have to comply with the federal laws in Titles 18 and 26.
    Basically it sounds like a state nullification bill over parts of the NFA and GCA.

    Now this could mean trouble with the feds for an individual if he exercises this law and creates his SBR or SBS without gong through the form 1 process. However this bill could be strengthened considerably by adding that no federal officers are allowed to enforce federal gun laws in this state as several states have now done.

    What does involuntarily deferred mean?

    From http://www.legis.la.gov/legis/Glossary.aspx

    A legislative instrument scheduled for hearing by a committee may be voluntarily deferred upon the request of the author or member handling the instrument. An instrument voluntarily deferred without objection may be rescheduled for committee hearing. A legislative instrument is involuntarily deferred when so ordered by a vote of a majority of the committee members present and voting, notwithstanding the request of the author or member handling it to report the instrument. An involuntarily deferred instrument may be rescheduled for a committee hearing (after opportunity for hearing all other House instruments requested to be heard) only by the vote of two-thirds of the committee members present and voting. During a session, the indefinite postponement of a bill usually means that the bill is dead for that legislative session. (House Rules 6.9 and 6.10)
