    If you are on my property, and refuse to leave when asked, you are trespassing. Simple trespassing is a misdemeanor, enforceable under the criminal code.

    Since the OP made no mention of asking them to leave, I agree with you, they were not trespassing, however, should you go back and review my post, I think you will find that was never my assertion.

    .... Several thousand years later the alien race that wiped out humanity decided to explore the far reaches of the universe. They were on the edge of the Teegnlkeesh Galaxy when they discover a downed spacecraft that looked oddly familar to a human airplane. They couldn't be sure though because they had only heard stories and seen very faded images of the craft. The commander decided to land on the planet only to discover that there was someone still alive aboard the crashed craft. The human like being was taken back to their planet and nursed back to health. While he was still under the aliens care he heard over heard talk of how closely he appeared to the race of humans they had previously destroyed. This intrigued Xenu, the being that was rescued from the far reaches of the Teegnlkeesh Galaxy. When he was better he went to the Planet Zeta information city and saw what they had done to his people. Angered by this revelation began developing a sinister plan to destroy Zeta. After all humans were his to sacrifice not their's. After months of planning he thought it best to break up the factions. As the resourceful slick tongued being he was turned the factions against each other one by one. He created war and calamity among Planet Zeta. As the elders watch their race turning against each other they felt ashamed that they had become what they destroyed so many years prior on Earth. In a final effort to reunite their planet. They held Peace conference. Everyone agreed that for one day they would not take up arms and would try to turn back to their peaceful ways. During this conference Xenu began to feel that his plan wasn't going to work. But how could he get revenge. He had one last idea. A juvenile idea really. He decided to take a child's Zphone 10k and place it in one of the other factions children's bag. While immature and not well thought out the child began to scream and cry when it could not play furious Teradactyls on its Zphone. Believing the child had lost its phone they called it only to discover the child of another faction had stolen it. Xenu's rediculous plan was working they began to fight and once again picked up arms against each other. Xenu believed he had won he had created chaos among the Zeta factions again. The Zeta elders were very disheartened but expected that the fighting wouldn't end. They had a plan though, they didnt feel as though they could go on living in this way. After all they had destroyed an entire race for this same behavior. Years prior they had developed a bomb designed to destroy black holes. The Zetians had voted to destroy the bombs because of how dangerous they were. After all the bomb had the power to destroy a black hole. The Elders had one of the bombs secretly removed and hidden away for dark and tragic times. Rather than watch their species turn against each other they armed the bomb. And without warning the bomb exploded. As Xenu watched space begin to implode in on him, he was in shock, unbelief, and fear for his plan had turned against him he had never seen such power and it was rushing straight for him. In his last moment he couldn't help but think that he caused his own demise much the way his people had thousands of years prior.

I am, however, smart enough to know that simple trespassing is a misdemeanor under the criminal code where I live.

    So my answer to you is, Hire a lawyer to answer your question, or go to the library and look it up.

    The only thing I have behind my name is Jr. but I've read the trespassing law many times and that's why I said they weren't trespassing.

    (2) A person, affiliate, employee, agent or contractor of any business which is regulated by the Louisiana Public Service Commission or by a local franchising authority or the Federal Communication Commission under the Cable Reregulation Act of 1992 or of a municipal or public utility, while acting in the course and scope of his employment or agency relating to the operation, repair, or maintenance of a facility, servitude or any property located on the immovable property which belongs to such a business.
    (3) Any person making a delivery, soliciting, selling any product or service, conducting a survey or poll, a real estate licensee or other person who has a legitimate reason for making a delivery, conducting business or communicating with the owner, lessee, custodian or a resident of the immovable property, and who, immediately upon entry, seeks to make the delivery, to conduct business or to conduct the communication.
    (4) An employee of the owner, lessee or custodian of the immovable property while performing his duties, functions and responsibilities in the course and scope of his employment.
    (5) The owner of domestic livestock or his employees or agents while in the process of retrieving his domestic livestock that have escaped from an area fenced to retain such domestic livestock.
    (6) The owner of a domestic animal while in the sole process of merely retrieving his domestic animal from immovable property and not having a firearm or other weapon on his person.
    (7) Any candidate for political office or any person working on behalf of a candidate for a political office.
    (8) The owner or occupant of a watercraft or vessel traveling in salt water engaged in any lawful purpose for the purpose of retrieval of his property or for obtaining assistance in an emergency situation.
    G. The following penalties shall be imposed for a violation of this Section:
    (1) For the first offense, the fine shall be not less than one hundred dollars and not more than five hundred dollars, or imprisonment for not more than thirty days, or both.
    (2) For the second offense, the fine shall be not less than three hundred dollars and not more than seven hundred fifty dollars, or imprisonment for not more than ninety days, or both.
    (3) For the third offense and all subsequent offenses, the fine shall be not less than five hundred dollars and not more than one thousand dollars, or imprisonment for not less than sixty days and not more than six months, or both, and forfeiture to the law enforcement authority of any property seized in connection with the violation.
    (4) A person may be convicted of a second offense and any subsequent offenses regardless of whether any prior conviction involved the same structure, watercraft, movable or immovable property and regardless of the time sequence of the occurrence of the offenses.
    (5) In addition to the foregoing penalties, and notwithstanding any other law to the contrary, a person convicted under this Section who has killed or otherwise misappropriated any wildlife, as defined by R.S. 56:8, in the course of commission of the offense shall forfeit the misappropriated wildlife to the law enforcement authority, and shall be ordered to pay the value of the misappropriated wildlife into the Conservation Fund of the Department of Wildlife and Fisheries in accordance with R.S. 56:40.1 et seq. The value of the wildlife that was misappropriated shall be determined by the guidelines adopted by the Wildlife and Fisheries Commission pursuant to R.S. 56:40.2.
    H. The provisions of any other law notwithstanding, owners, lessees, and custodians of structures, watercraft, movable or immovable property shall not be answerable for damages sustained by any person who enters upon the structure, watercraft, movable or immovable property without express, legal or implied authorization, or who without legal authorization, remains upon the structure, watercraft, movable or immovable property after being forbidden by the owner, or other person with authority to do so; however, the owner, lessee or custodian of the property may be answerable for damages only upon a showing that the damages sustained were the result of the intentional acts or gross negligence of the owner, lessee or custodian.
    I. A minor ten years old or younger shall not be arrested, detained or apprehended for the crime of trespass.

    Once again. Please go back and re-read. I NEVER said that the ICE agents in the OP's post were trespassing.

    What I inferred, was that if they had been asked to leave the physical boundaries of the private property, and they refused, they would, AT THAT POINT, been guilty of simple trespassing. The Sheriff's deputies would, at that point, been obligated by their oath to enforce the law. It is my experience that most sheriff deputies take the oath to uphold the laws seriously, and would have informed the ICE agents that they had to leave the property. I doubt, at that point, they actually would arrest them, but you never know. Perhaps there would be a deputy that objected to escorting a ICE agent at one in the morning, who would take the opportunity to poke that agent in the chest, . . . , so to speak.
    It is my understanding, (again, I am no attorney, nor did I sleep in a motel Six last night), that the local Sheriff's office actually has the power to execute an arrest, and is the, . . . , what's the word, . . . the official with the most power in his jurisdiction.

    Once again. You should never take legal advice from a Home Improvement Salesman. If you doubt any of this, hire an attorney to authenticate it, or refute it.

    If they had no warrant, and were not there to execute an arrest, what official duty would they have, at that point, to be on private property?

    (5) In addition to the foregoing penalties, and notwithstanding any other law to the contrary, a person convicted under this Section who has killed or otherwise misappropriated any wildlife, as defined by R.S. 56:8, in the course of commission of the offense shall forfeit the misappropriated wildlife to the law enforcement authority, and shall be ordered to pay the value of the misappropriated wildlife into the Conservation Fund of the Department of Wildlife and Fisheries in accordance with R.S. 56:40.1 et seq. The value of the wildlife that was misappropriated shall be determined by the guidelines adopted by the Wildlife and Fisheries Commission pursuant to R.S. 56:40.2.
    H. The provisions of any other law notwithstanding, owners, lessees, and custodians of structures, watercraft, movable or immovable property shall not be answerable for damages sustained by any person who enters upon the structure, watercraft, movable or immovable property without express, legal or implied authorization, or who without legal authorization, remains upon the structure, watercraft, movable or immovable property after being forbidden by the owner, or other person with authority to do so; however, the owner, lessee or custodian of the property may be answerable for damages only upon a showing that the damages sustained were the result of the intentional acts or gross negligence of the owner, lessee or custodian.
    I. A minor ten years old or younger shall not be arrested, detained or apprehended for the crime of trespass.

    Thanks that's what I was referring to but I was talking on the phone and couldn't post the exceptions in the RS. I've had people arrested under 14:63 and read it many times.

    If they had no warrant, and were not there to execute an arrest, what official duty would they have, at that point, to be on private property?

    Performance of duties is a broad term. Cops do more than just arrest people. If your not smart enough to get that then good luck with life. If your just being a goober than thank you for being done and shutting up.

    I couldn't imagine the stuff you would post if they would have showed up with a warrant, kicked his dog, rammed his door, and cuffed and stuffed him over a silly Facebook comment.

    And FWIT, no judge would ever sign a warrant with that silly of PC. And All Fed LEOs carry way more power than any state local or sheriff, just so you know. They can claim jurisdiction over anything they so choose so long as USC covers it and the locals really can't do **** about it. They try to be diplomatic about it, but if push comes to shove they flex their nuts and it's done.

    Spreading something as legal or true without being able to either validate it or stand on your own credentials has been an issue in the past. On a gun forum, you dont want "common knowledge" cause a lot of people (a lottttt) would end up in jail or worse over misinformation.

    Thus, a rule is born.

    LE does not need a warrant just to talk to someone. If that was the case, then LE would have to get a warrant just to order food during 10-40.
    When anyone tries to talk to anybody it is called "Free Association" and is considered part of the First Amendment. Everyone also has a right not to associate with others. In other words, LE can simply walk up to you and speak to you. You have the right to simply refuse conversation or talk to them for as little or as long as you like.
