    PART II-A. MISCELLANEOUS PROVISIONS

    §1796. Preemption of state law

    A. No governing authority of a political subdivision shall enact after July 15, 1985, any ordinance or regulation more restrictive than state law concerning in any way the sale, purchase, possession, ownership, transfer, transportation, license, or registration of firearms, ammunition, or components of firearms or ammunition; however, this Section shall not apply to the levy and collection of sales and use taxes, license fees and taxes and permit fees, nor shall it affect the authority of political subdivisions to prohibit the possession of a weapon or firearm in certain commercial establishments and public buildings.

    B. Nothing in this Section shall prohibit a local governing authority in a high-risk area from developing a plan with federally licensed firearms manufacturers, dealers, or importers to secure the inventory of firearms and ammunition of those licensees in order to prevent looting of the licensee's premises during a declared state of emergency or disaster. Such plan shall be renewed on a periodic basis. The information contained in the plan shall be deemed security procedures as defined in R.S. 44:3.1 and shall be released only to the sheriffs of the parishes or police chiefs of municipalities in which the declared state of emergency or disaster exists.

    C. For the purposes of this Section:

    (1) "Declared emergency or disaster" means an emergency or disaster declared by the governor or parish president pursuant to the provisions of the Louisiana Homeland Security and Emergency Assistance and Disaster Act.

    (2) "High-risk area" means the parishes of Assumption, Calcasieu, Cameron, Iberia, Jefferson, Lafourche, Orleans, Plaquemines, St. Bernard, St. Charles, St. James, St. John, St. Martin, St. Mary, St. Tammany, Tangipahoa, Terrebonne, and Vermilion.

    (e) Exceptions. The following exceptions to this section apply:
    (1) An ABO licensed to sell firearms or containing an indoor shooting gallery shall be exempt from this section in those areas designated for the sale of firearms or the shooting gallery.


    That's too good to be true. An Alcoholic Beverage Outlet licensed to sell firearms, or having a shooting range. Sounds safe to me.
    actually, the last abo and ffl holding and selling person/establishment I frequented was a nice place. Nothing untoward ever occurred there that I am aware.

    Although LA R.S. 14:95.4, the state law referenced in the proposed ordinance, is still on the books, we were taught from day one that it's constitutionally "shaky" and no longer of use. As explained to us by some of the older veterans teaching at the academy, in the old days when this was commonly done, police would walk into certain establishments and as the patrons knew they were about to be rousted and searched, there'd be a series of "clunks" and "clangs" as various weaponry hit the floor. With no ownership claimed, the officers collected and walked out with a handful of guns, knives, brass knuckles, etc., and hopefully there'd be no serious bloodshed that night. In 12 years I've never known of any officer actually searching anyone based upon the premise of 14:95.4.

    As for the proposed ordinance, it sounds like a load of horsesh!t and needs to be thrown out, along with whatever idiot is proposing it.
    I have always wondered how this law is still on the books.

    that dog must be confused... he's acting like an "occupier" but he appears to be politically aligned with the tea party.

    Dog is obviously a socialist.

    It expects someone else to feed it, clean up after it, and house it, while having no concerns what-so-ever about where the money will ultimately come from. It just manages to get lucky and do something right every now and then like a clock that's broken.

    The dog expects shelter and food because his owner has chosen to give it. With his (owners) time and money. The dog is "owned" by someone and subject to his masters whims and desires. Is this what we want for our children and grandchildren?

    Several years ago, the NRA proposed opening a restaurant/bar/shooting range in the Quarter. I wonder whatever became of that idea.
