Actually, I don't think it's necessary. According to Senate policy, Kirk's term expired on Tuesday with the election. Until Brown is seated, they are just short one Senator.

the democrats if they want to will interpret the 17th amendments succession clause how they need to since there has been no supreme court precedence set. what has to be looked at is the law that massachusetts passed last year and when does it say kirk must step down.

with these people you have to assume they will be willing to trample on the Constitution and the will of the people, that’s what they have made a career of.
