    The guy should have called the cops and gone inside his house. If they had broke into his house he would have had a better reason to use force but not some loud mouth out on the lawn. Now he'll be in the pokie for a long time with his life and that of his family ruined. Not very bright.

    You guys may be missing a more important underlying message in this. The media ran with it hoping to degrade support for "stand your ground" laws. They don't give a rats ass about this guy or his family nor the victim or his family.

    If you read between the lines, you can see their true intent. What a bunch of phonys!

    Don't see anyway he wasn't the agressor.

    He had the right to ask a neighbor to turn down the noise...and somehow he turned a simple request into a confrontation. And it seems to me that he turned it into a confrontation b/c he had a gun.

    Man who claimed self-defense sentenced to 40 years for killing neighbor

    A man who claimed Texas' version of a stand-your-ground law allowed him to fatally shoot a neighbor after an argument about a noisy party was sentenced Wednesday to 40 years for murder.

    Raul Rodriguez, 46, had faced up to life in prison for the 2010 killing of Kelly Danaher.

    Rodriguez, a retired Houston-area firefighter, was angry about the noise coming from a birthday party at his neighbor's home. He went over and got into an argument with 36-year-old elementary school teacher Danaher and two other men at the party.
