    The ATF can’t arrest anyone for owning a pistol-brace-equipped gun.

    That’s the outcome of a ruling handed down by United States District Court Judge Matthew Kacsmaryk on Wednesday. He granted a motion to stay enforcement of the agency’s rule banning the possession of effectively all braced guns that weren’t registered earlier this year. He found the ATF exceeded its power when crafting the rule.

    “[T]he Court is certainly sympathetic to ATF’s concerns over public safety in the wake of tragic mass shootings. The Rule ’embodies salutary policy goals meant to protect vulnerable people in our society,'” Judge Kacsmaryk wrote in Britto v. ATF. “But public safety concerns must be addressed in ways that are lawful. This Rule is not.”

    Unlike previous rulings against the ATF, Kacsmaryk’s order applies to the entire rule. That means it could affect tons of gun owners nationwide, with the number of affected braced guns estimated to be in the millions or even tens of millions.

    Its really high time citizens refuse to comply with the ATF all together. Whether its Trumps bump stock ban or Biden's shady attempts to indermine gun ownership, it's all unconstitutional. That makes it unlawful per Article VI: Supreme Law. They engage in lawfare and thuggery to impose these unconstitutional bans and regulations. It's really time to fight back to fight fire with fire. Can you imagine if these foolish leaders banned AR15s and we had an uprising or attack like we witnessed in Israel? No thanks: I will never comply.

    Within 48 hours maybe much sooner another judge will reverse it …and so on and so on.

    The ruling can, and most likely will, be appealed. But that appeal will be to the 5th circuit, where it will almost certainly be upheld.

    The ATF may keep wasting taxpayers money on further actions, but this issue is now dead for the foreseeable future.

    I wish it were the case this issue is dead for the foreseeable future. I don't believe this was a constitutional decision. I believe the courts said the atf violated the rule making procedure. If the atf doesn't appeal this or doesn't win the appeal, they can simply resubmit a new rule that follows the listed procedure.

    In reality I think the worst that would happen is you or another mod would take it down and then it would create a “ my thread disappeared” thread and we would talk about how some post have disappeared over the years without explanation.

    i did 2 for the amnesty and i just got back another one approved paid. only thing that was keeping me from sbr is the form you have to fill out for moving sbr across state lines. now i only shoot in my home state so that no longer matters. i would rather the courts strike sbr's from nfa but it looks like we getting the status quo.
