This LITERALLY happened to a guy in Tennessee. The sheriff department arrested a guy for shooting at 3 perpetrators breaking into his van that was parked in his driveway. They fired on the home owner first and he returned fire. He was arrested because he told law enforcement that as he retreated into his home, he closed his eyes as he fired back at the perpetrators. He was then arrested for reckless endangerment for closing his eyes as he fired. True story

And this is why if you ever have to fire a gun at someone, that you only speak to police in the presence of an attorney, even if you are completely 100% innocent.

I remember one, years ago, where a guy in NO East shot a guy breaking into
his van from his second floor apartment balcony. No charges filed.
